Arnold and Maria Make It Official

On the Friday before the Fourth of July, Maria Shriver made her long-expected divorce from Arnold Schwarzenegger official when she filed divorce papers. The two separated tumultuously after the news broke that Schwarzenegger fathered a child out of wedlock with a former maid of the family. Because there was no prenuptial agreement in place, the talk now centers on who gets what.

California is a community property state, which means that the any property that the two acquired while they were married is part of their marital estate. Without a prenuptial agreement outlining how the two will split property, a court will likely split all of the martial estate property 50/50 if it comes to that. However, the two sides are more likely to settle before a trial and decide for themselves who gets what.

Both Shriver’s and Schwarzenegger’s attorneys are high-profile divorce attorneys who are well accustomed to celebrity splits. The settlement negotiations are likely to take several more months, as the two sides battle it out over property settlement. Shriver is seeking alimony, which will also add complexity to the negotiations. And, as in most celebrity divorce cases, the public will probably never know anything about the settlement, as it is likely to be confidential.
